Professor Elisa Fornalé (WTI, University of Bern) - who taught the course 'Climate Migration and International Protection' for MIDI students - is an expert on migration at the international level, with a particular interest in the links between climate change and migration flows. In addition to her position as Principal Investigator at the World Trade Institute, since 2018 she has been a member of the International Law Association (ILA), one of the oldest and most prestigious associations in the field of international law, which set up an ad hoc committee in 2012 to study the impact of sea-level rise and the potential role of international law, as well as its implications for people affected by it.

The financial guarantee - an analysis by Prof. Cavasino

Prof. Elisa Cavasino, full professor in constitutional law at the University of Palermo, comments on the new institution of the financial guarantee, introduced by the decree of 14 September 2023, which requires foreigners to pay a sum of 4,938 euros during the procedure to ascertain the right to enter Italian territory, thus regulating the way in which this guarantee is provided.

The new border procedure - detention of asylum seekers

Prof. Mario Savino, Professor of Administrative Law at the University of Tuscia, explains some of the innovations introduced by Law no. 50 of 5 May 2023, which, with amendments, converted Legislative Decree no. 20 of 10 March 2023, which contains urgent provisions on the subject of legal entry flows of foreign workers and the prevention and combating of irregular immigration. In particular, it analyses the accelerated procedure at the border with detention of the asylum seeker from a country of origin considered safe.
Albania, Algeria, Bosnia-Herzegovina, Cape Verde, Côte d'Ivoire, Gambia, Georgia, Ghana, Kosovo, North Macedonia, Morocco, Montenegro, Nigeria, Senegal, Serbia and Tunisia. This is the list updated by the decree of the Ministry of Foreign Affairs and International Cooperation of 17 March 2023.

After the entry into force of Law no. 50/2023 (Cutro Decree), the first judgments issued by the Courts of Catania and Florence, which did not confirm the detention orders for migrants from safe countries of origin, were: the Judgment of Judges Minniti, Fabbrini and Sturiale of the Court of Florence of 20 September 2023 (no. R.G. 9787 /2023); the Judgment of Judge Apostolic of the Court of Florence of 20 September 2023 (no. R.G. 9787 /2023); the Judgment of Judge Apostolic of the Court of Florence of 20 September 2023 (no. R.G. 9787 /2023); the Judgment of Judge Apostolic of the Court of Florence of 20 September 2023 (no. R.G. 9787 /2023). 9.2023 (no. R.G. 9787 /2023); the order of the Apostolic Judge of the Court of Catania of 29.9.2023 (no. R.G. 10461/ 2023); the order of the Judge Cupri of 08.10.2023 (no. R.G. 10798 /2023).
The disapplication of the legislation is based on different principles invoked by the judges, decisions that differ from each other. Regarding the decision of the Apostolic Judge, Prof. Sapienza points out: "This decision takes into account human rights.

Alternative exams, non-formal methods - Interview with Prof. Clelia Bartoli

Italian and foreign students of the Migration, Rights, Integration - MIDI course at the University of Palermo, together with CPIA and the Erasmus programme, explored the theme of borders, both visible and internal. Through workshops using non-formal methodology, they reflected on the causes and consequences of migration phenomena and shared experiences and knowledge in a debate with other law students. The initiative, which was also an exam, was enriched by the guidance of Prof. Clelia Bartoli, lecturer in the politics of migration and human rights, who narrated the day in a video with the participants.
