Abstract

Are the essential levels of assistance (LEA) a finalized limit on the discretion of regional public authorities in the use of the financial resources allocated in the budget? Can the qualification in “clinical” and not “welfare” terms of healthcare facilities limit access to top positions in an unlimited way without the activation of open and selective procedures? The T.A.R. Lombardy, Sec. Brescia did not understand the relevance of the issues contained in the two previous questions, essentially leaving the hands free to the political power in diverting financial resources from essential healthcare services and in conferring top positions in healthcare in a direct manner outside the meritocratic principle.
