Abstract

Analyzing recent regulations on "digital currencies", such as the Proposed Regulation on the Digital Euro and MiCAR, the book highlights the creation of differentiated legal statutes for the currency, resulting in the creation of regulatory arbitrage, compliance burdens and prejudices for protection of consumers and users. Given these markedly sectoral regulations, and the uncertain nature of crypto-assets, the book therefore attempts to offer, where possible, an extensive interpretation of the regulations on payment services and MiCAR, in order to safeguard the coherence and unity of the financial system and of the payment system, after a legal qualification of the individual types of crypto-assets. The book also focuses on the current relationship between public money and private money.
