The essay focuses on the perspective of investigation in which feelings, gen- erators of acts and mute rules of behavior among family members, act as implicit and latent rules, non-verbalized, “decision criteria” that temporally precede the written norm of family law, spontaneously followed by individuals, shared by a given community, but5– even more importantly5– to which the judge adheres to !nd the solution to the speci!c case.
