Abstract
The article is an analysis of the text Gai Institutiones 4.163. It casts doubt on the correctness of Otto Lenel’s reconstruction of the formula arbitraria in the interdictal procedure sine poena. It concludes the earlier version by August Friedrich Rudorff is more correct.
