Abstract

Vat. Fr. 92 and the restitutory nature of the interdicts Quem fundum and Quem usum fructum. – The interdicts Quem fundum and Quem usum fructum were restitutory injunctions sanctioning the lack of defensio in the formular procedure. This is clear from a text transmitted by the Vatican palimpsest no. 5766 (Vat. Fr. 92). The attempt to argue that the two interdicts were prohibitory cannot be considered successful.
