Riccobono e la critica interpolazionistica

Abstract

Riccobono’s method of textual criticism of the Roman legal sources was developed in Berlin at the school of Gradenwitz, and subsequently finalized during his studies in Rome with Scialoja. Already in his first publications he showed awareness towards a reluctant application of the interpolationistic method. Riccobono addressed the weakness of textual criticism of Humanistic Jurisprudence and stressed the validity of the approach of the Italian glossators and commentators. The controversy on the correct use of the interpolationistic method linked ideological aspects to the desire to defend the ‘romanità’ of the Corpus iuris ciuilis. Even after the decline of this method of researching the sources of Roman law, Riccobono’s work continues to represent a very important legacy.
