La disciplina del minuscolo: la Corte costituzionale alle prese con la ragionevolezza del divieto assoluto di scambiare oggetti per detenuti al 41-bis

Abstract

This paper aims to analyse the reasoning of the Italian Constitutional Court judgment about the strict prohibition to give and receive objects among detainees under article 41-bis. The main issues focus on the empirical and criminological plausibility of transferring monitoring tasks to the jail authorities in order to verify the actual danger of each exchange.
