La dimensione valoriale della concorrenza e del mercato: profili costituzionali

Abstract

This paper addresses the theme of the role of competition and the market in the constitutional text starting from the debate that took place in the Constituent Assembly on this point. Although the constituents did not think of the market and its functioning according to competitive rules as a value to be protected, the Constitution proved to be very inclusive of the culture of the market beyond what the constituents would have ever imagined. A very important role can be traced back to the impact that the EU rules relating to the market and competition have produced on the national economic Constitution within a relationship of "mutual influence" and not of subservience of the latter to the former. The work concludes with some mention of the developments in constitutional jurisprudence after the reform of Title V of the Constitution which introduced the protection of competition among the matters subject to exclusive state competence.
