L’eliminazione degli effetti pregiudizievoli dovuti a violazioni accertate dalla Corte EDU

Abstract

The Italian legislator recently introduced an ad hoc remedy that allows the elimination of prejudicial effects of ECHR violations, following a ECtHR judgement. The chapter aims to highlight the main issues concerning this tool, both carrying out a comparison with the former solution (which was provided by a Constitutional Court decision) and considering possible new questions.
