Giustizia riparativa e processo penale: un rapporto che si evolve tra promesse e incomprensioni

Abstract

Following a recent reform (the "Cartabia Reform", namely Legislative Decree Nr. 150/2022), the relationship between restorative justice and Italian criminal proceedings is evolving. The paper aims to analyse the mains issues concerning this developing scenario, in the light of first solutions found by case-law and opinions expressed in legal literature.
