The paper analyses the recent developments of the Italian legislation regarding flexible con-tracts in the societies controlled by public administrations. It aims to demonstrate that such developments are deeply rooted in the Italian jurisprudence’s traditional approach to the topic, with some differences, originating by the European Court of Justice influence
