Intervento pubblico, mercato e imprese: alcune considerazioni sull'attualità e il pensiero di Ottaviano

Abstract

The reading of V. Ottaviano’s work on Intervento pubblico, mercato e imprese represent the opportunity to develop some observations about today’s relationship between State and market, into the constitutional context, and to verify how current is the Sicilian Master’s thought. In particular, starting from the evolution of the regulatory framework, which has experienced a deep mutation for the past 30 years, the focus is pointed on the more recent interpretations of Constitutional Court and doctrine, trying to synthesise how, learning from Vittorio Ottaviano, the solidarity principle along with the equality principle could represent a fundamen- tal point to define the limits of State’s intervention in economy, in compliance with European law.
